Judge extends probation term

A Spencer woman’s probation was extended for six months because she allegedly violated probation seven times in eight months. 

Associate Cherokee County District Court Judge Andy Smith extended Ashley Fields’s probation until April 13, 2024, per an agreement recommended by Fields and County Attorney Ryan Kolpin. Fields, 38, agreed to the extension, according to court records. 

She admitted to violations the Iowa Department of Correctional Services leveled against her in a filing in April. She allegedly missed probation appointments, tested positive for methamphetamine and failed to pay court costs and probation supervision fees stemming from a deferred judgment in 2021. Fields received a two-year probation sentence after she pleaded guilty to burglarizing a motor vehicle in rural Cleghorn. 

Under the terms of Smith’s order, Smith won’t be convicted of the burglary charge — her deferred judgment will remain in place. And she avoided up to two years in prison, which could’ve been imposed if she was convicted of the burglary charge. 

Cherokee man harasses 911 operator

A Cherokee man was arrested for calling 911 for an ambulance, and then threatening a dispatcher who was asking questions about the incident. 

Kevin Anderson, 56, was booked into the Cherokee County Jail Oct. 16 for first-degree harassment, a misdemeanor. Anderson allegedly called 911 at around 12:44 a.m. Oct. 12 for an ambulance to transport his girlfriend to a hospital. He then became upset with a dispatcher and threatened to kill him, according to an affidavit filed by the Cherokee County Sheriff. 

Anderson was booked on a $2,000 bond. He was released the following day, pending an initial appearance that will be set at a later date. 

Probation, treatment for meth

A Cherokee man was sentenced to five years probation and a term in a residential treatment facility for possessing felony-level amounts of methamphetamine and precursors for narcotics sales. 

Cherokee County District Court Judge Duane Hoffmeyer sentenced Scott Engelke, 55, to the probation term and RTF stay in an order Oct. 9. Engelke agreed to serve the sentence, according to court records. He pleaded guilty to a single felony count of conspiracy to deliver less than five grams of methamphetamine. In exchange, County Attorney Ryan Kolpin agreed to recommend probation in lieu of 10 years in prison. 

Engelke was arrested last August after officers executed a search warrant at his residence at 420 Cherry St. They found methamphetamine, small plastic bags, cash and scales “commonly used for the sale of controlled substances,” according to an affidavit filed by Cherokee police. 

A warrant was issued for Engelke’s arrest 11 days after Judge Hoffmeyer’s order. Kolpin filed a sealed warrant application and an application to revoke Engelke’s five-year probation sentence in a filing Oct. 20. Judge John Sandy issued the warrant for Engelke’s arrest on the same day, court records show.
